Our Visitors: When you visit the Mall of Switzerland or our website www.mallofswitzerland.ch and use our associated products and services (together “Services”), we process your data for the provision of the Services, the preparation of contract conclusion, and for the performance of the corresponding contract. More information about our Services can be found here. Our Services are primarily aimed at persons with residence and habitual residence in Switzerland:
- When we enter into a contract with you, for example when you use our parking garage, purchase a gift card from us, use our Wi-Fi, rent a wheelchair, use childcare services, or register for events, we process the data from the pre-contractual phase or registration (e.g., in the order form) and information about the contract conclusion itself (e.g., date of conclusion and subject matter of the contract). During and after the contract period, we process information about the contract or the use of services, payments, contacts with customer service, claims, complaints, termination of the contract, and—should disputes arise in connection with the contract—also information about these and corresponding proceedings.
- When you visit the Mall of Switzerland, photo and video recordings of you may also be made. This primarily serves to prosecute criminal offenses and violations of regulations and to enforce our house rules, but we may also use the recordings for non-personal statistical purposes. These recordings are deleted within three months unless there is an overriding interest in retaining them.
- Before entering into a contract, we may check the creditworthiness of our contractual partner, i.e., the probability of payment default, especially when we provide services in advance or when we assess whether to offer a particular payment option. For this purpose, we obtain address and credit information from Dun & Bradstreet or Trace, a credit agency. Dun & Bradstreet or Trace maintain their own database for this purpose. We use this data only for address verification and credit checks and then delete it (except for a current address). To the extent it is useful for contract conclusion, we may also obtain additional data from public registers (e.g., the commercial register) or the internet.
- If you register and log in on one of our websites (e.g., on https://www.mallofswitzerland.ch/intranet-login), we process the information collected during registration and information about your actions while you are logged in or before or after a login if we can associate the collected data with you (see also Section 5).
- If you order services from us online (e.g., on https://shop.boncard.ch/mallofswitzerland), we process your contact details, the shopping cart or order, information about the delivery location and shipping, and payment information.
- If you transmit data to us in other ways, for example [when participating in a competition or sweepstakes], we process the data transmitted, for example [to notify or publish the winners].
- We also process the aforementioned data for statistical analyses that support the improvement and development of products and business strategies. We may also use it for marketing purposes on a personal basis; you can find further information on this in Section 4.
You may transmit data to us that also relates to other persons (e.g., representatives, employees, relatives, beneficial owners). We assume that this data is correct and that you are authorized to provide it to us. - If you register and log in on one of our websites (e.g., on https://www.mallofswitzerland.ch/intranet-login), we process the information collected during registration and information about your actions while you are logged in and/or before or after a login if we can associate the data collected at that time with you. For contractual partners that are companies, we process less personal data because data protection law only covers data of natural persons (i.e., people). However, we do process data of contact persons with whom we are in contact, e.g., name, contact details, professional information, and information from communications, and information about executives, etc., as part of general information about companies with which we work.
You may transmit data to us that also relates to other persons (e.g., representatives, employees, relatives, beneficial owners). We assume that this data is correct and that you are authorized to provide it to us. We ask that you inform these persons about our data processing (e.g., by referring them to this Privacy Policy) if such information is legally required.
Our Visitors: We process personal data to advertise our services and services of third parties:

Our Visitors: Each time you use our website, certain data is generated for technical reasons and temporarily stored in log files (log data). This includes in particular the IP address of your device, information about your internet service provider and the operating system of your device, information about the referring URL, information about the browser used, date and time of access, and the content accessed when visiting the website.

Our Visitors: Cookies and similar technologies from third-party providers enable them to create analyses and evaluations for us so that we can understand how our website is used and optimize our online offering. Among other things, we use Google Analytics, an analysis service from Google LLC (Mountain View, USA) and Google Ireland Ltd. (Dublin, Ireland). Google collects certain information about your behavior on the website and about the device you use. The IP addresses of visitors are shortened in Europe before being forwarded to the USA. Based on the recorded data, Google provides us with analyses, but also processes certain data for its own purposes. Our Visitors: We maintain our own presences on social networks and other platforms (in particular on Instagram, Facebook, YouTube, and TikTok). If you communicate with us there or comment on or share content, we collect information for this purpose, which we use primarily to communicate with you, for marketing purposes, and for statistical analyses (see Sections 4 and 6).
Please note that the platform provider also collects and uses data (e.g., on user behavior) itself, possibly together with other data known to it (e.g., for marketing purposes or to personalize platform content). To the extent that we are jointly responsible with the provider, we enter into a corresponding agreement, which you can inquire about with the provider.
